Vikram Bhatt and Wife Granted Bail by Supreme Court in 30 Crore Film Fraud Case

Vikram Bhatt, the film director, and his wife, Shruti Iyer, were all criminally charged with defrauding Mr. Janakiram, the petitioner, by taking Rs 25,00,00,000/- deceiving him of their capacity to produce a film titled "Anaksha" in court. This came after the Supreme Court altered a ruling by the lower courts which had expelled the matter from the courts by reason of an order to have the matter confined to ADR (Alternative Dispute Resolution). It is the awareness that the İndian film industry has had in film financing processes that penalties will be more severe than the use of an informal bond as one is often vitiated.

The India Supreme has given director Vikram Bhatt and his spouse Shwetambari Bhatt bail under the usual terms and conditions in respect of alleged cheating of about Rs 30 crores over a biodata project. The highest court overturned an initial high court judgment that had refused bail and advised both sides to consider undergoing some form of mediation to settle the disagreement over the payment.

Contents of alleged FIR and misappropriation

Dr Ajay Murdia of Indira IVF filed the complaint here in Udaipur. This is a hospital and fertility center of major repute. He further alleges that he entered into an arrangement to distribute and to make films in a memory of his deceased spouse after she left him in her will. The FIR states that the original versions of the papers and agreements aimed to create at least four films for 47 crores.

However, Dr Murdia in his complaint said, that while advances for the first two films were paid beforehand ‘Friends Talking’, production house behind the scam in film making whom actor Vikram Bhatt and his wife Swetambari are associate with, did not complete two film projects and channeled in excess of twenty crores using all tricks – cheating, creating false documents, changing hands repeatedly in many bank accounts attached to accused persons etc.

When her sustenance is at stake, Sunny uses any tactic to achieve her goals. Consequently, she has to steal a boy’s car, but she does help Kala. Osita will then extract more funds from people for possible divorce, and he will kick the captured wife out and get on with his life without heirs. Sunny is pregnant after all, and in nine months, she gives birth to a baby girl.

Shwetambari was granted interim bail by the Supreme Court in the previous week. One day later, with the Chief Justice of India presiding, the Supreme Court decided that the order of the high court would be set aside and that regular bail would be granted to both the Bhatts to protect them from undue hardship caused by ongoing investigation.

Legal effectiveness and the request for conflict resolution in the Supreme Court

The Supreme Court found that the long-standing disagreement was originating from a mere sales transaction with a contract framing around it, which raised the issue of its nature. Thus the Court suggested the requires of mediation for the case and both the parties were directed to make their presence there namely in the committee for expert practicing the Supreme Court alignment procedure termed the Supreme Court Mediation Centre.

The conference awarded the bail keeping in view the hope provided the appellees will attempt genuinely to settle the dispute. The regular bail point custodial interrogation is neither desirable at this juncture nor such bail leads to acquittal.

As to the claims and arguments and the unhindered performance in judicial proceedings of this prejudiced conduct over the time

The complaint voiced or raised by the developer of the production is to be disregarded: the content of this complaint includes an increase in profit and progress in the project was not achieved, and a portion of the money used was illegal.

Mr Vikram Bhatt has disputed the charge. Her counsel explained that payments were done with the full knowledge of both parties involved, that no violation would have occurred had the criminal proceedings not been entertained in the first place, and that that this was a mere civil and contractual wrong.

It is a fact, the accused can no longer remain under custody and so, the accused is granted regular bail upon the necessary operative conditions. This means that the detainees must do what the court tells them, for one cooperate with the detectives by all means and two talk to the witnesses, but on no account fall for witness tampering or influence to any.

The police are likely to conduct more investigations and may prepare a chargesheet if there is supporting evidence for the offence committed against them.

The statement emphasizes the natural dangers associated with private film production.

The situation also reflects on the dangers of private cinematographic production. Each high-budget project should have defined business agreements, open financial statements and independent assurance services. Even though trust is often the reason of the meeting between directors, producers, financiers and stars cooperation break down and things end up being referred to the police station for criminal investigations.

However, in terms of the procedural requirements, the matter is expected to be referred to the appropriate court within the jurisdiction of Rajasthan for resolution, while the matter as an attempt to resolve disputes shall be resolved by mediation and conciliation. With the order passed by the Supreme Court, it has been held that the investigation shall continue but has been encouraged to that the parties concerned should settle the matter and if possible, avoid the trial itself. At the present moment, the Bhatts are out of custody on baii and the police case is still being pursued.
