Am I a criminal? SC pauses Pawan Khera’s bail in Assam CM’s wife’s case

The Supreme Court has stopped Pawan Khera's temporary bail in a case where the wife of the Chief Minister of Assam says he damaged her reputation, and has told him to ask for bail before a court in Assam before he's arrested. The Court was firm about submitting correct paperwork and said the accusations against the CM's wife are serious; Khera has said she has multiple passports.

On Friday, the Supreme Court stopped Khera’s temporary bail in the case brought by the Assam CM’s wife and won’t allow him to continue with the ‘transit anticipatory bail’ he had. They told Khera to go to a proper court in Assam to ask for anticipatory bail as quickly as possible.

Supreme Court order and immediate direction

This is the second time the Court has halted the protection Khera had, and they refused to extend it until Tuesday. They said any application for anticipatory bail has to be made to the correct court in Assam and be decided based on its own details.

Justices Maheshwari and Chandurkar made it clear the Assam court should make its own decision based on the evidence it has, and that the Supreme Court’s previous statements won’t limit how the trial court in Assam hears Khera’s request.

Defense arguments and pleas for short relief

Abhishek Manu Singhvi, a leading lawyer representing Pawan Khera, asked for a short extension to the bail. He pointed out that courts in Assam weren’t open, and there weren’t many options for filing paperwork online. He said his request was a simple one about procedure and was vital to make sure Khera could get to the right court in time.

Singhvi also explained to the judges that a hold placed on a decision from the Telangana High Court came about because of a misunderstanding about the documents filed in a hurry. He said any error was accidental and a person shouldn’t be denied their freedom for a small mistake.

Court concerns about incorrect documents and seriousness of the matter

The judges were concerned about the incorrect documents that were submitted and didn’t want to give Khera the extension he asked for. Justice Maheshwari emphasized how serious it is to present false information to a court, and didn’t agree that the issue was minor.

The Supreme Court remembered stopping the Telangana High Court’s ruling earlier in April and said this case needs very careful examination by the courts. The judges told the lawyers that the suitable court in Assam could put Khera’s request for anticipatory bail on the schedule quickly if they needed to.

Background of the defamation FIR and allegations

The case started because Pawan Khera stated on April tth that the Assam Chief Minister’s wife has multiple passports from different countries. Because Indian law doesn’t allow being a citizen of more than one country, this claim is both legally and politically important.

The police in Guwahati began an investigation (an FIR) on April 5th, and on April 7th they searched Khera’s home in Delhi. Khera at first got ‘transit anticipatory bail’ from a High Court, but the Supreme Court stopped that order and then paused his temporary protection.
